Actions Underway in a Push to Repeal the Medical Device Tax

In the first full week of January 2015, Congressman Eric Paulsen of Minnesota’s 3rd district introduced H.R.160, the Protect Medical Innovation Act of 2015, to the 114th U.S. Congress. This bill amends the Internal Revenue Code to repeal the 2.3% excise tax on medical device manufacturers and importers that was included in the Patient Protection and Affordable Care Act. Presently, the bill has 260 co-sponsors. Amendments would apply to sales after December 31, 2012, and the bill would allow device companies to seek refunds for taxes already paid.

The following week, on January 13, a bipartisan group led by Senate Finance Committee Chairman Orrin Hatch of Utah introduced the Medical Device Access and Innovation Protection Act, S. 149, a bill to repeal the medical device tax. The bill has 16 co-sponsors.
